Terms of Service and Privacy Policy

1. Definitions

• SocialBuzzers/We/Us: NeuralNode AI Solutions (sole proprietor company, Dumdum, Kolkata, West Bengal, India).
• Service: The SocialBuzzers platform at www.socialbuzzers.com and related applications that allow users to generate and schedule social media campaigns.
• Account/You/User: Any user (individual or business) who registers for and uses the Service.
• Platforms: Third-party social networks integrated with the Service (Facebook, Instagram, LinkedIn, Pinterest, X (Twitter), YouTube, TikTok).
• Platform Policies: The official rules of each social network. Users must comply with those policies when posting content.
• AI-Generated Content: Any text, image, or other material produced by SocialBuzzers’ AI tools and offered to the user for review and posting.
• Personal Data: Any information that identifies you, such as name, email, phone, address, and social account identifiers.
• Usage Data/Analytics: Non-identifying information about how you use the Service (e.g. visited pages, time stamps, engagement metrics collected via platform APIs).

2. Privacy Policy

2.1 Data We Collect

• Account Information: When you register, we collect your name, email address, and any other information you provide (e.g. billing address). We may ask for a phone number or postal address if needed.
• Social Accounts: If you connect a social network account via OAuth, we collect the data needed to use that account. This includes your profile name, profile picture, page IDs, and an access token. We request only the following permissions from each platform:
  • Facebook/Instagram: Read profile, Read page info, Publish posts, Schedule posts, Read analytics, Read comments.
  • LinkedIn: Read profile, Read company/page info, Post content, Read analytics.
  • Pinterest: Read profile, Read pins, Create pins, Read analytics.
  • X (Twitter): Read profile, Read tweets, Post tweets, Read analytics.
  • YouTube: Read channel info, Post video, Read analytics.
  • TikTok: Read profile, Post video, Read analytics.
• Usage and Technical Data: We automatically collect your device’s IP address, browser/OS type, pages of our site visited, login timestamps, and unique device ID for security purposes.
• Cookies and Tracking: We use cookies and similar technologies to personalize your experience, remember preferences, analyze usage, and support security. You can control cookies via your browser settings, but disabling essential cookies may impair the Service.
• Content You Provide: Any images, logos, videos, or text you upload to use in campaigns are also collected. You retain ownership of this content, but you grant SocialBuzzers a license to use it to provide the Service.

2.2 How We Use Your Data

We use your data only to operate and improve SocialBuzzers:

• Providing and Maintaining Service: We use your data to generate, schedule, and publish your social media posts on connected platforms. For example, we use your page IDs and tokens to post on your behalf.
• Analytics: We use analytics data (engagement metrics, impressions, etc.) from the social APIs to show you campaign performance. We store aggregated or de-identified metrics (e.g. total likes, impressions) to improve the platform. We do not sell or share identifiable analytics for advertising.
• Communications: We may send you emails or notifications about your campaigns, account updates, and Service changes. You can opt out of non-essential marketing emails.
• Legal Compliance and Safety: We process data to comply with laws (e.g. accounting, tax) and to protect users (e.g. detect fraud or harmful content).

We will not sell, rent, or share your personal data with third parties except as described in this policy (e.g. with Service Providers or affiliates, who must protect it).

2.3 Data Sharing

• Service Providers: We may share data with trusted third parties who help us run the Service (hosting, email delivery, analytics, payment processing). They only use data on our behalf and under confidentiality obligations.
• Affiliates/Partners: We may share data with corporate affiliates for administrative purposes, always under this privacy standard.
• Marketing Partners: We do NOT share data to target you outside your connected social platforms. We comply with requirements like “No Unauthorized Profiling” and “Zero Data Sales.”
• Legal Requirements: We will disclose data if required by law or a valid court order.
• Your Consent: With your permission, we may share information as agreed (for example, to post content on a specific platform).

2.4 User Rights and Control

Under India’s Digital Personal Data Protection Act (2023), you have rights:

• Notice and Consent: We collected your data to provide the Service, as disclosed here. As required by law, before collecting your data, we informed you of the purpose.
• Access/Correction: You can access and update or delete your personal data. Visit your account settings or contact us (below).
• Erasure: You can request deletion of your account and data at any time. We will verify your identity and then delete your data from our records (see section 5).
• Opt-out: You may opt out of receiving marketing emails by following unsubscribe instructions.
• Cookies: You can manage or block cookies via browser settings. Essential service cookies may remain if you block others.
• Complaints: If dissatisfied, you may lodge a complaint with SocialBuzzers (contact below) or with the Data Protection Board of India.

We keep your personal data only as long as needed: for active accounts, until account termination or a specific retention period (e.g. analytics are kept up to 24 months). After closure or upon request, we delete or anonymize data unless retention is legally required (e.g. tax records).

2.5 Data Security

We implement reasonable organizational and technical safeguards (encryption, access controls, etc.) to protect your data. However, no internet system is 100% secure; we cannot guarantee absolute protection. In case of a data breach, we will notify affected users and authorities as required by law.

3. Terms & Conditions of Use

3.1 Service Use

• Eligibility: You must be at least 18 years old to use SocialBuzzers. By using the Service, you represent that you meet this requirement.
• Account: You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account. Notify us immediately of any unauthorized use.
• Client Uploads: You alone are responsible for any content (images, text, logos) you upload or generate via AI. Ensure you have all necessary rights/consents for anything you post. You grant SocialBuzzers a non-exclusive license to use your uploaded content only to provide the Service.
• AI Content: SocialBuzzers’ AI generates campaign ideas or text suggestions. You must review all AI-generated content before publishing. You are the author of such content; SocialBuzzers does not independently verify accuracy. We disclaim any liability for inaccuracies or offensive content in AI suggestions. You retain editorial control.
• Auto-Publishing: When you schedule posts, we may publish them automatically at your scheduled time. Ensure scheduled content is finalized in advance, as it will go live unless you cancel.
• Supported Content: You may upload images, logos, or video (subject to file-type and size limits) to include in campaigns. We do not assume any quality or legality guarantee for your media; that is your responsibility.

3.2 User Responsibilities

• Compliance with Platform Policies: You agree to follow the Terms and Community Standards of each connected platform (Meta, LinkedIn, etc.) when posting. For example, you must not use protected health or personal information to target ads, must not post spam or infringe copyrights, and must obtain consent for any personal data you share. SocialBuzzers does not monitor your posts for compliance; if your content is blocked or your account banned by a platform, SocialBuzzers is not liable.
• Lawful Conduct: Do not use SocialBuzzers for illegal, harmful, or abusive content. Prohibited content includes (but is not limited to): harassment, hate speech, explicit adult content, illegal activities, or any content infringing intellectual property rights. Do not use the Service to post ads with false, deceptive, or unverified claims (e.g. unapproved medical or financial advice). You must not upload viruses or attempt unauthorized access to others’ accounts.
• No Scraping or Reverse-Engineering: You agree not to reverse-engineer our AI, use our service to scrape data from any platform, or otherwise attempt to repurpose our tools beyond the intended use of scheduling social content.

3.3 Payment and Subscription

• Plans: SocialBuzzers operates on a monthly subscription model. Fees and payment schedules are displayed on our website and your account dashboard. By subscribing, you authorize recurring charges to your chosen payment method.
• Billing Cycle: Subscriptions renew automatically each month on the anniversary of your signup, unless cancelled at least 7 days before renewal. We will notify you of any price changes at least 30 days in advance.
• No Refunds: All payments are non-refundable. No refunds or credits will be provided for partial months or unused features. We do not guarantee any specific results (e.g. follower count or engagement levels) from use of the Service.
• Delinquency: If payment fails, we may suspend or terminate your account until you update payment. You remain responsible for unpaid fees and any collection costs.

3.4 Termination

Either party may terminate an account: You may cancel anytime via your account settings. SocialBuzzers may suspend or terminate accounts at our discretion (e.g. for AUP violations or non-payment). Upon termination, we delete or anonymize your personal data as described above. You must pay any outstanding fees up to the date of termination.

4. AI Content and Platform Compliance Disclaimer

SocialBuzzers provides tools to generate and schedule social media content, but all content is ultimately created and published by you. We strongly emphasize:

• Review Required: You must review and approve any AI-generated content before posting. Do not assume AI text or images are accurate or legally safe. Check facts, citations, and ensure compliance (e.g. with advertising laws) before publishing.
• No Guarantee: We do not guarantee engagement, follower growth, or acceptance by any platform. Each network has its own rules (e.g. branded content, ads, spam) which you must follow. If a platform suspends your post or account, SocialBuzzers is not liable.
• User as Author: When you publish a scheduled post, you are the author/publisher. You bear sole responsibility for its content. SocialBuzzers is merely a technology provider and does not “claim” any content as our own or verify its legality.
• Sensitive/Special Content: If you target sensitive topics (e.g. health, finance, religion), ensure compliance with all applicable laws. We are not responsible for evaluating such compliance.

This disclaimer limits SocialBuzzers’ liability. By using the Service, you acknowledge that SocialBuzzers is not the author or publisher of your content, and you indemnify SocialBuzzers for all claims related to your posts.

5. Data Deletion and Your Rights

You may request deletion or correction of your personal data:

• Data Deletion: Email us at admin@neuralnode.in with “Data Deletion Request” and your account details. We will verify your request (to prevent fraud) and delete your personal data within 30 days, except where retention is required by law (e.g. financial records).
• Account Closure: You can close your account in settings or via email. Upon closure, your profile and content are removed from our system.
• Data Retention: We retain only what is necessary. For example, we keep basic account records to prevent fraud and for legal compliance, but erase analytics data beyond a reasonable period (typically 2 years) or upon request.
• Consent Withdrawal: You can withdraw consent at any time by closing your account and requesting data deletion. This does not affect processing done before withdrawal.
• Complaints: If unsatisfied with our response, you may escalate to the Data Protection Board of India or other authorities.

6. Acceptable Use and Copyright

• DMCA/Copyright: If you believe your copyrighted work was posted via SocialBuzzers without permission, contact us at admin@neuralnode.in. We will promptly remove or disable access to the material if it infringes others’ rights.
• Prohibited Use: Users must not use the Service to infringe any third-party IP, publish defamatory or unlawful content, or violate any laws. We reserve the right to refuse or remove any content, and to terminate accounts that violate these rules.
• No Unauthorized Ads: Do not use the Service to send unsolicited promotions or violate spam laws (e.g. posting identical content across multiple networks indiscriminately).

7. Disclaimers and Limitation of Liability

• No Warranty: The Service is provided “as is”. We disclaim all warranties (express or implied). We do not guarantee the Service will be uninterrupted, error-free, or meet your needs. We are not liable for losses from downtime or data inaccuracies.
• AI Accuracy: As noted, AI-generated content may be incorrect. We disclaim liability for any damages arising from reliance on such content.
• Platform Dependence: SocialBuzzers relies on third-party platforms. We are not responsible for any changes or outages on Facebook, LinkedIn, etc.
• Limitation: To the maximum extent permitted by law, SocialBuzzers (and the owner) shall not be liable for indirect, incidental, or consequential damages. Our total liability is capped at the amount you paid in the last 12 months.
• Indemnity: You agree to defend and indemnify SocialBuzzers from any claims or expenses (including legal fees) arising out of your use of the Service or violation of these terms.

8. Arbitration and Governing Law

These Terms, and any disputes, are governed by Indian law (West Bengal). Any dispute will be resolved by binding arbitration in Kolkata, in English. You waive any right to class-action litigation. Any enforcement notices should be sent to admin@neuralnode.in or to our address below.
